Below you will find detailed and specific information from the sales contract established between Fabe and its customers when making an online purchase.

Pursuant to Italian Legislative Decree no. 206/2005 and as provided for by Italian Legislative Decree no. 21 of 21 February 2014, the Consumer has the right to withdraw from the contract concluded with the Seller without specifying the reason within 14 calendar days from the date of receipt of the products purchased. As provided for by article 59 paragraph 1 letter “c” of Italian Legislative Decree no. 21 of 21 February 2014, the supply of custom-made or clearly personalised goods shall be excluded from the exercising of the right of withdrawal. As provided for in art. 59 paragraph 1 letter “e” of Italian Legislative Decree no. 21 of 21 February 2014, the supply of sealed goods that are not suitable for return for reasons of hygiene or reasons related to the protection of health and that have been opened after delivery shall be excluded from the exercising of the right of withdrawal. To withdraw from the contract, the Consumer must notify the Seller through an explicit declaration (registered mail, fax or email) within and no later than 14 calendar days from the date they received the goods, clearly stating: their intent to exercise the right of withdrawal, the name and quantity of the product or products they wish to return, the details of the bank account to which they would like the refund to be made (IBAN). In the event that the Consumer does not have their own bank account, they may provide those of a family member or acquaintance, authorising Fabe to credit the amount to said current account. The Consumer is obliged to return the products to the Seller within 14 calendar days from the date of request for withdrawal, ensuring, however, to await the Seller’s written authorisation (which should be provided no more than 3 calendar days from the Consumer’s notification of their intention to exercise the Right of Withdrawal).
The packaging and the integrity of the products during transportation is the responsibility of the Consumer. Every product to be returned must be packed in such a manner as to be protected during transportation. If the Consumer has not kept the original packaging or if the original packaging is no longer intact, the Consumer is required to provide for packaging that is equally as resistant. Products returned with open or torn packaging will not be accepted.
Once the Right of Withdrawal has been verified, the Consumer will be reimbursed for all payments they have made to the Seller for the order and the returned product, including delivery costs (excluding extra costs for additional services), without undue delay and in any case no later than 14 calendar days from the day on which the Seller was informed of the Consumer’s decision to withdraw from this contract.
In order for the Right of Withdrawal to be properly implemented, as well as complying with the terms and procedures described in points 1.1, 1.2, 1.3, 1.4 and 1.5, the following terms and conditions must also be adhered to: any product bearing clear signs of use (e.g. fur, hair, make-up, rings, stains or any other element which is not a part of the product itself), washing, damage or alteration will not be refunded. The purpose of the Right of Withdrawal is to provide the Consumer the opportunity to examine the product as though they were in a shop, and not to use the product free of charge. For reasons of hygiene, products must be returned in their original packaging and still sealed. The transparent protector does not prevent the Customer from assessing the characteristics and texture of the product visually and by touch. The Fabe label is an integral part of the product and must therefore still be attached. Returned products must be sent to the Seller in a single consignment. The Seller reserves the right not to accept products from the same order that are returned and sent at different times. Returned products must be consigned to the carrier within 14 calendar days from the date on which the Consumer has correctly and fully requested the exercising of their Right of Withdrawal (see point 2). The Seller hereby informs the Consumer that if the returned product is found to have defects or anomalies that the Consumer has not declared, the Right of Withdrawal will be voided.
The Seller is required to reimburse all payments that they have received from the Consumer using the payment method that was used for the initial purchase, including delivery costs, within 14 calendar days from the day on which they were informed of the Consumer’s decision to withdraw from the contract. However, goods are to be returned at the Consumer’s expense. The Seller will commence with the refund procedures once it has been ascertained that the terms and conditions, detailed above and as described in paragraph 2 have been properly fulfilled. In the event that the procedures, terms and conditions for exercising the Right of Withdrawal are not adhered to, the Consumer will lose their Right of Withdrawal; they may, however, regain the products returned to the Seller at their own expense. Otherwise, the Seller may retain the products as reimbursement for expenses, in addition to the amount already paid for their purchase.
Once the products have been received, the Seller will carry out the necessary checks to assess whether the terms and conditions detailed in paragraph 1 have been adhered to. In the event that the result of said checks is positive, the Seller will send an email to confirm that the returned products have been accepted.
Regardless of the payment method used by the Consumer, the refund is to be issued by the Seller as soon as possible and in any case within 14 calendar days from the date on which the Seller was informed of the Consumer’s request to exercise the Right of Withdrawal, subject to verification that said request has been made properly and the returned products have been accepted.
In the event that the recipient of the products as stated on the order form does not correspond with the person who made the payment, Fabe will refund the relevant amount to the latter.
